Terms of Service

1. Acceptance of Terms

By accessing or using the EV platform (“Service”), including our API, expert dashboard, and website, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EV provides an AI oversight platform that evaluates AI-generated outputs against policy rules and risk triggers, and routes high-risk outputs to credentialed domain experts for human review. The Service includes automated risk assessment, expert verification, audit trail generation, and API access.

3. User Accounts

API Clients: Companies that integrate our API receive an API key upon registration. You are responsible for maintaining the confidentiality of your API key and for all activity under your account.

Experts: Domain experts who apply and are approved to review AI outputs. Expert accounts are subject to the separate Expert Agreement.

4. Acceptable Use

You agree not to use the Service to:

  • Submit content that is illegal, threatening, or violates third-party rights
  • Attempt to reverse-engineer, decompile, or extract the risk engine or matching algorithms
  • Circumvent rate limits, authentication, or security measures
  • Submit outputs containing personally identifiable patient, client, or customer data unless you have appropriate authorization and data processing agreements in place
  • Misrepresent EV review results as regulatory certification or legal compliance guarantees

5. Pricing and Payment

API Clients operate on a prepaid balance model. Reviews are charged at the time of submission based on the selected urgency tier. Auto-cleared outputs are charged at the auto-clear rate. Escalated outputs are charged at the corresponding urgency tier rate. Prices are subject to change with 30 days notice.

6. Expert Reviews

Expert reviews represent the professional opinion of individual credentialed reviewers. EV facilitates the connection between AI companies and experts but does not independently verify the accuracy of every expert correction. EV is not a law firm, medical practice, financial advisory firm, or any other licensed professional service provider.

7. Audit Trail and Data

Every output processed through the Service generates an audit record including timestamps, risk assessments, routing decisions, expert actions, and disposition. Audit records are retained for a minimum of 7 years to support compliance requirements.

8. Data Ownership

Your Data: You retain ownership of all AI outputs you submit through the API. EV does not claim ownership of your content.

Review Data: EV retains the right to use anonymized and aggregated review data (including risk patterns, accuracy benchmarks, and domain-level statistics) to improve the Service, train internal models, and generate industry reports.

Expert Content: Expert corrections, verdicts, and notes become part of the review record and are shared with the submitting client.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. EV DOES NOT GUARANTEE THAT EXPERT REVIEWS WILL BE ERROR-FREE, THAT THE RISK ENGINE WILL CATCH EVERY ISSUE, OR THAT USE OF THE SERVICE WILL ENSURE REGULATORY COMPLIANCE. THE SERVICE HELPS SUPPORT OVERSIGHT REQUIREMENTS BUT DOES NOT CONSTITUTE LEGAL, MEDICAL, FINANCIAL, OR COMPLIANCE ADVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO EV IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold EV harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. EV may suspend or terminate your access for violation of these Terms. Upon termination, your API key will be revoked. Audit records will be retained per our data retention policy.

13. Modifications

EV may modify these Terms at any time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service constitutes acceptance of modified Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes shall be resolved in the courts of Dallas County, Texas.
